National information and online forms concerning Regulation No. 805/2004.
The Regulation 805/2004 applies between all Member States of the European Union with the exception of Denmark.
It dispenses, under certain conditions, with all intermediary measures in the Member State in which enforcement is sought that have been necessary so far for decisions delivered in another Member State in the verifiable absence of a dispute over the nature or extent of a debt. Those conditions mainly concern the service of documents in the case of judgments by default. Abolishing exequatur will enable creditors to obtain quick and efficient enforcement abroad without involving the courts in the Member State where enforcement is applied for in time-consuming and costly formalities.
The Regulation provides for six standard forms.
Submission of forms to competent authority
Completed forms should be sent to the relevant competent authority in a manner required by the authority. Από την 1η Ιανουαρίου 2021, το Ηνωμένο Βασίλειο δεν είναι πλέον κράτος μέλος της ΕΕ. Ωστόσο, στον τομέα της αστικής δικαιοσύνης, οι εκκρεμείς διαδικασίες και δίκες που ξεκίνησαν πριν από τη λήξη της μεταβατικής περιόδου θα συνεχιστούν βάσει του δικαίου της ΕΕ. Μέχρι το τέλος του 2024, θα είναι δυνατή η επιλογή του Ηνωμένου Βασιλείου στα ηλεκτρονικά (δυναμικά) έντυπα που συμπληρώνονται για τους σκοπούς των εν λόγω διαδικασιών και δικών. Εξαίρεση σ΄ αυτόν τον κανόνα αποτελούν τα έντυπα δημόσιων εγγράφων, κατά τη συμπλήρωση των οποίων δεν θα είναι δυνατή η επιλογή του Ηνωμένου Βασιλείου.
Σας ενημερώνουμε ότι, σε περίπτωση αδράνειας από μέρους σας μεγαλύτερης των 30 λεπτών, όλα τα στοιχεία που έχετε εισαγάγει θα χαθούν, εκτός αν αποθηκεύσετε ένα πρόχειρο σχέδιο!
