Please note that although every effort has been made to ascertain the accuracy of the results, there may be some exceptional cases concerning the determination of competence that are not necessarily covered.
Article 10 - Information on competent courts or authorities
Under Chapter 474 of the Laws of Malta, the Mediation Act, the parties, or one of them with the explicit consent of the other, may request that the content of a written agreement resulting from mediation be made enforceable subject to the provisions of Chapter 12 of the Laws of Malta - the Code of Organization and Civil Procedure. The content of such an agreement shall be enforceable unless, in the case in question, the content of that agreement is contrary to national law. The content of the agreement may be made enforceable by a court or other competent authority in a judgment or decision or in an authentic instrument in accordance with the law of the Member State where the request is made.
