In some cases, when the applicant or the intervening party in the proceedings is not Belgian and the respondent is Belgian, the latter may, in the absence of an international agreement providing for dispensation and except in special circumstances, request that the applicant or the intervening party provide surety to guarantee payment of damages arising from the action. This is provided for in Article 851 of the Judicial Code.
The costs of bailiffs and lawyers (see above) and translators and interpreters (see below) must also be taken into account, as appropriate.
Stage in civil proceedings when a party must settle fixed costs
Some costs must be settled before an action is brought. This applies to the registry fee, which is collected when the case is entered in the register.
Costs arising during the proceedings are generally collected while the proceedings are underway.
For some costs a reserve has to be established. In this way, experts are paid from a reserve established by the party that sought the measure of inquiry. Likewise, Article 953 states that the party requesting that a witness be heard must, before such hearing, deposit a reserve with the registrar representing the amount of the allowance and the reimbursement of costs (travel, etc.).
Costs in legal proceedings are sometimes advanced by lawyers and therefore included in their statement of costs and fees.
Fixed costs due from all parties in criminal proceedings
The issue of fixed costs in criminal proceedings is regulated under Article 91 et seq. of the Royal Decree of 28 December 1950.

If the victim files a complaint with an application to join proceedings as a civil party with the investigating judge (Article 66 of the Code of Criminal Procedure), the latter has the option to request that the victim deposit a certain amount of money with the registrar of the court. They may, depending on their degree of insolvency, be exempted, in full or in part, from paying the costs of bailiffs, experts, etc. This matter is governed by Article 664 et seq. of the Judicial Code.

Caso A - Situazione nazionale: una coppia si sposa. Successivamente i due coniugi si separano e decidono di comune accordo di divorziare.
Caso B - Situazione transnazionale: due cittadini dello stesso Stato membro (Stato membro A) si sposano. Il matrimonio viene celebrato nello Stato membro A. Dopo il matrimonio la coppia si trasferisce a vivere e lavorare in un altro Stato membro (Stato membro B) dove stabilisce la propria residenza. Poco dopo i due coniugi si separano: la moglie torna nello Stato membro A e il marito rimane nello Stato membro B. Decidono di comune accordo di divorziare. Al suo ritorno nello Stato membro A, la moglie chiede immediatamente il divorzio dinanzi agli organi giurisdizionali dello Stato membro B.
Osservazione preliminare importante: in Belgio le spese e gli onorari d'avvocato non sono disciplinati (dipendono dalla difficoltà e dalla rilevanza della causa, dal nome e dalla reputazione dell'avvocato, dall'urgenza della questione, dall'esito della causa, ecc.). In Belgio tuttavia gli avvocati sono vincolati da norme di deontologia e sono tenuti per legge a stimare le spese in maniera equa e moderata (v. supra).

Caso A - Situazione nazionale: due persone convivono da un certo numero di anni senza aver contratto matrimonio. Al momento della separazione hanno un figlio di tre anni. Un organo giurisdizionale concede l'affidamento del minore alla madre e il diritto di visita (droit de visite) al padre. La madre intraprende un'azione legale per limitare il diritto di visita del padre.
Caso B - Situazione transnazionale dal punto di vista di un avvocato che esercita la professione nello Stato membro A: due persone convivono da un certo numero di anni in uno Stato membro (Stato membro B) senza aver contratto matrimonio. Hanno un figlio ma si separano immediatamente dopo la sua nascita. Un organo giurisdizionale dello Stato membro B concede l'affidamento del minore alla madre e il diritto di visita al padre. La madre e il minore si trasferiscono in un altro Stato membro (Stato membro A), con l'autorizzazione dell'organo giurisdizionale, mentre il padre rimane nello Stato membro B. Alcuni anni dopo la madre intraprende un'azione legale per modificare il diritto di visita del padre.
Osservazione preliminare importante: In Belgio le spese e gli onorari d'avvocato non sono disciplinati (dipendono dalla difficoltà e dalla rilevanza della causa, dal nome e dalla reputazione dell'avvocato, dall'urgenza della questione, dall'esito della causa, ecc.). Una decisione assegna la custodia del minore alla madre. L'unico punto controverso non risolto riguarda l'importo del mantenimento dovuto alla madre dal padre per le cure e l'educazione del minore. La madre avvia una causa.
Caso B - Situazione transnazionale dal punto di vista di un avvocato che esercita nello Stato membro A: due persone hanno convissuto senza vincolo matrimoniale nello Stato membro B. Al momento della separazione il minore ha tre anni. Una decisione pronunciata nello Stato membro B assegna la custodia del minore alla madre. Resta in sospeso un elemento di controversia relativo all'importo del mantenimento dovuto alla madre dal padre per le cure e l'educazione del minore. La madre avvia una causa nello Stato membro A.

Caso A - Situazione nazionale: una società consegna merci per un valore di 20 000 EUR. Il venditore non è stato pagato perché l'acquirente ritiene che le merci non corrispondano a quanto convenuto.
Il venditore decide di intentare una causa per ottenere il pagamento integrale.
Caso B - Situazione transnazionale: una società la cui sede sociale è stabilita nello Stato membro B consegna merci per un valore di 20 000 EUR a un acquirente stabilito nello Stato membro A. La legislazione dello Stato membro B è applicabile al contratto, che è redatto nella lingua dello Stato membro B. Il venditore non è stato pagato perché l'acquirente stabilito nello Stato membro A ritiene che le merci non corrispondano a quanto convenuto. Il venditore decide di intentare una causa nello Stato membro A per ottenere il pagamento integrale del prezzo previsto nel contratto firmato con l'acquirente.

Questi vende l'apparecchio a un cliente che lo installa al proprio domicilio. Poco dopo la casa s'incendia. Le parti (fabbricante, installatore, cliente finale) sono assicurate. L'origine dell'incendio è contestata. Nessuno vuole risarcire il cliente.
Il cliente decide di citare il fabbricante, l'installatore e le compagnie di assicurazione per ottenere un risarcimento completo.
Caso B - Situazione transnazionale: un fabbricante di apparecchiature per il riscaldamento stabilito nello Stato membro B consegna un'apparecchiatura a un installatore stabilito nello Stato membro C, che la rivende a un cliente nello Stato membro A che lo monta al proprio domicilio. Poco dopo la casa s'incendia. Ciascuna delle parti (fabbricante, installatore, cliente finale) è assicurata presso una compagnia di assicurazione nel proprio Stato membro. L'origine dell'incendio è contestata. Nessuno vuole risarcire il cliente.
Il cliente decide di intentare una causa nello Stato membro A contro il fabbricante, l'installatore e la compagnia di assicurazioni nello Stato membro A per ottenere un risarcimento completo.
