Search case law pertaining to freedom of movement and other EU citizen's rights

Introduction

Case law of higher national courts pertaining mostly to the implementation of Directive 2004/38/EC. Particularly the entry and residence requirements that may be imposed on EU nationals and their family moving to another EU country, definition of a family member, and the grounds on which a Member State is entitled to restrict their rights.

Several cases involve the examination of alleged discrimination on the grounds of nationality; some of the case law concerns political rights (voting and participating in the European Parliament elections and in municipal elections in a Member State of residence).

The search tool

The documents returned by the search tool are a result of an outsourced commissioned project "Living in another Member State: barriers to EU citizens' full enjoyment of their rights".
