  • Nota preliminar

    Lack of transparency that provokes, surreptitiously, an alteration not of the objective balance between price and performance, which in general is not controllable by the Judge, but of the subjective balance of price and benefit. Requirement of information on an essential element of the contract that produces substantial imbalance to the detriment of the consumer, objectively incompatible with the requirements of good faith, consisting of the impossibility of making a faithful representation of the economic impact that will involve obtaining the loan with "soil clause" in the case of lowering of the benchmark index. There is a lack of sufficiently clear information, which is a defining element of the main object of the contract; it is inserted jointly with the ceiling clause and as an apparent consideration of the same. Result: nullity.

  • Cuestión jurídica

    There is a lack of sufficiently clear information regarding a defining element of the main object of the contract; it is inserted together with the ceiling clause with the intention of giving the impression of equality between both clauses. Result: nullity.

  • Decisión

    The article 6, paragraph 1, of the Directive 93/13/CEE, 5 April 1993, about unfair terms inserted in contracts concluded with consumers, must be construed in the sense that it opposes the National Case Law, which imposes a time-limit on the restorative effects linked to the declaration of the abusive nature, within the meaning of Article 3, paragraph 1, of that Directive, of a clause included in a contract concluded with a consumer by a professional, circumscribing such restitution effects exclusively to amounts unduly paid in application of that clause, subsequent to the pronouncement of the judicial declaration by which the clause in question was declared unfair.
