    Breach of duty pursuant to § 10 par. i) of the Act No. 159/1999 Coll., when the claimants were unable to take part in the entirety of the tour as well as the common breach of duty of the customer.

    The defendant entered into a travel contract with the plaintiff, under which he was to arrange a cruise for the two plaintiffs which they would board in Miami, where they were to fly to from Prague. The plaintiffs did not have a visa to enter the United States of America, nor did the plaintiffs hold a valid passport. In the proceedings, it was proved that the plaintiffs received only the defendant catalogue for year 2009/2010, in which the visa requirement was missing. They also did not receive the current catalogue for 2010/2011, nor were they advised on the necessity of having a valid passport and visa.

    Obligations of the travel agency: duty of information. What are the limits?

    There are certain precautionary requirements for a person preparing for a foreign tour because if they do not receive (at all or in time) the travel document information from the travel agent, they should not remain completely inactive. It is a well-known fact that a number of countries require a visa upon entry, or that there are certain passport requirements. There is certainly a difference between a situation where a client relies on travel agency data for conditions of entry into exotic countries, as opposed to a situation where he is not given relatively accessible, and more or less well-known information, about travelling to the US. In other words, the lack or full absence of a travel agent's message, regarding visa and/or passport requirements, cannot lead the client to the conclusion that they fulfil the conditions for entering a foreign country if this is contrary to generally known and achievable information for most of the society.
