    The consumer submits as evidence an expert's report reflecting the lack of conformity relating to the detached parquet floor, demanding that the defendant be held responsible for the defect. The Court concludes that the detachment is due to a lack of professionalism.

  • Feiten

    The consumers stated that they were reassured by the information they received from the seller, the accuracy of which was confirmed by the VDH. However, the consumers cannot reasonably take the position that they no longer expected that the dogs would not get HD. It cannot be inferred from the wording of the sales contracts that the purchaser does not have to be afraid of HD when breeding with two HD-free parents. The seller has only guaranteed that the parents of the dogs are HD-free and has stated that he has only provided information about HD, other conditions that are common in German shepherd dogs, and about the character traits of these dogs. The consumers were only allowed to expect that the chance that the dogs would get HD was relatively small, because the parents of the dogs are HD-free. They themselves have argued that the chance of HD with such parents is between 3% and 9%. The idea that a pedigree guarantees that the dog in question is healthy is a misconception that should remain at the expense of the consumers. Their claim, therefore, was dismissed.

  • Uitspraak

    The Court of Appeal is of the opinion that no lack of conformity can be assumed in this case. It understands from the parties’ assertions that hip dysplasia (HD) is a hereditary disorder that has been common in large dog breeds such as the German shepherd dog for many years. In addition to the hereditary predisposition, other factors, such as nutrition and exercise, influence the development of HD and the severity of the complaints it causes. There was no guarantee that the dogs of the consumers would be free of HD. It is certain that the consumers knew before the purchase that HD was common among German shepherd dogs and that they were very afraid to get a dog with HD again. Precisely for this reason, prior to the sale, they extensively discussed the risk of HD with the seller and subsequently obtained information from the Vereniging van Fokkers en Liefhebbers van Duitse Herdershonden (VDH), the association of breeders and enthusiasts of German shepherd dogs.
