    Review of clauses in leases by a non-commercial building association: The tenant must be made clearly aware of the future events that may lead to the termination of the lease.

  • Sachverhalt

    The defendant is a non-commercial building association within the meaning of article 1 WGG, specifically being a cooperative with limited liability. It is a company within the meaning of article 1 of KSchG and regularly enters into legal transactions with consumers within the scope of its business activities. It concludes purchase and rental contracts or use contracts with consumers in accordance with the WGG using boilerplate contracts.

    The following clause is intransparent since not all changes to general parts require the express consent of the landlord: "The outside of the object is not included in the use. Therefore, the tenant may not change anything and, in particular, may not impair the external appearance of the building. The attachment of devices and inscriptions to facades or other general parts of the building without the prior consent of the landlord is inadmissible"
