    Regulation (EC) No 1223/2009 of 30 November 2009 on cosmetic products does not have the effect of exempting cosmetic products from the provisions of the Consumer Code resulting from the transposition of Directive 2005/29 EEC of the European Parliament and of the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market, since the aim of both these texts is to protect consumers. The Directive may apply, in a complementary manner, to claims relating to cosmetic products if they are the result of a misleading commercial practice.

  • Faits

    During an inspection carried out in 2013 by the services of the Departmental Directorate for Social Cohesion and Protection of Populations (DDCSPP) on the premises of a company, infringements were found concerning a cream and a food supplement, produced by Monegasque laboratories and marketed by said company. The Besançon Court of Appeal found the company guilty of misleading commercial practices and sentenced it to a €7,000 fine. The court also upheld the prevention of the use of an unauthorised health claim in the labelling of a foodstuff and sentenced the company to 390 fines of €100.

    The Court of Cassation recalls that Regulation (EC) No 1223/2009 of 30 November 2009 on cosmetic products does not have the effect of exempting cosmetic products from the provisions of the Consumer Code resulting from the transposition of Directive 2005/29 EEC of the European Parliament and of the Council of 11 May 2005 concerning unfair commercial practices and concludes that a company may be held criminally liable for a misleading commercial practice in relation to a cosmetic product when this practice has been carried out on its behalf or when it aims to take advantage, ultimately, of the error induced and to benefit from the commitments that may be made as a result of the misleading practice.
