    Although the seller is not obliged to ascertain the number of kilometres actually driven, this does not mean that he can absolve himself of liability by a general notification of the possible (hypothetical) existence of a discrepancy between the number of kilometres declared in the sales contract and the actual mileage, if it has not been proven that the parties agreed that the buyer would assume the risk of a discrepancy between the declared condition in the contract of sale and the actual mileage of the item sold and that it was for this reason that they agreed a discount on the purchase price.

  • Skutkový stav

    A consumer as a buyer has bought a used car from an entrepreneur. In addition to the purchase price, he also paid for the preparation of the car for sale and for the so-called "carlife guarantee". The offer and contract stated that the car had 149 300 km on the odometer. In the handover report, the actual mileage was marked as 'possible discrepancy - no warranty'. The consumer had the actual mileage verified and found from the vehicle history report that the vehicle had actually covered 324 537 km. Due to the significant difference between the mileage on the odometer and the actual mileage, which the consumer considered to be a significant breach of the purchase contract, the consumer withdrew from the contract and demanded a refund of the purchase price.

    Is it sufficient for an entrepreneur to absolve himself of liability for defects of the sold goods by merely pointing out to the consumer the possible discrepancy in actual mileage and by not guaranteeing the mileage stated in the offer and purchase contract?

  • Rozhodnutí

    If the vehicle is identified in the purchase contract by, among other things, the odometer mileage, then its technical condition must also correspond - among other features - to the mileage. The seller cannot absolve himself of liability by simply stating that he may not guarantee the state in which the car is sold.
