    Headnote: Holidays are an important part of the working year, which is meant for rest and gaining new energy. The consumer chooses the holiday according to the information available from the catalog and the travel contract, while legitimately expecting the holiday to correspond with the presented description. With regard to relatively short and costly holidays, in which a substantial part of the agreed terms of the contract has been breached, consumers may be disappointed and claim non-pecuniary damage for the holidays destroyed.

    Consumers concluded a travel contract with the travel agency, however, upon arrival at the destination, they found that the place had a significant number of defects, which they had to deal with repeatedly. However, the Court of Appeal stated that the defects described could not have caused a qualified breach of travel that the defects could not have resulted in the applicants losing their holiday enjoyment.

On this basis, the court must determine the amount of non-pecuniary damage.

    The Supreme Court stated that the decision of the lower court is in conflict with the settled case law of the Supreme Court, and therefore an appeal against this decision is not only admissible but also justified. The Supreme Court therefore set aside the judgement of the Court of Appeal and remanded the case for further proceedings.
