    The Court finds in favour of the airline, ruling that the repatriation flight does not constitute 're-routing' under the regulation, therefore, the passenger is not entitled to reimbursement of costs.

  • Facts

    A passenger and his wife had their return flight cancelled by Austrian Airlines due to the COVID-19 pandemic. They subsequently checked into a repatriation flight organised by the Austrian State and had to pay a mandatory contribution to the costs. The passenger sued Austrian Airlines for reimbursement of this sum, alleging breach of the airline's obligations under Regulation (EC) No 261/2004.
