  • Leitsatz
    1. Wer als Verbraucher seine Vertragserklärung selbst zu Papier bringt und dieses Schriftstück (per Post oder Telefax) dem Unternehmer übersendet, ist so zu behandeln, als hätte er die Vertragserklärung in den Geschäftsräumen des Unternehmers abgegeben.
    2. § 3 Abs 1 erster Halbsatz KSchG ist jedenfalls im Liegenschaftsverkehr analog auf alle Örtlichkeiten anzuwenden, die dem Vertragsabschluss über bewegliche Sachen in den Geschäftsräumen des Unternehmers gleichkommen.
    3. Die formale Konzeption des § 3 Abs 1 KSchG verbietet eine teleologische Reduktion der in § 3 Abs 1 und 3 KSchG normierten Rücktrittsvoraussetzungen nach Maßgabe der konkreten Überrumpelungsgefahr.
  • Sachverhalt
    In her lawsuit, the plaintiff argued that the purchasing contract should be honoured. She held that the defendant was not entitled to a right of withdrawal under § 3 para 1 KSchG because she had accepted the offer by fax and, in cases where a contract is agreed in writing, the right of withdrawal under the KSchG does not apply. The defendant asked for the case to be dismissed, arguing that all statements contained in the faxes were made on her premises and not on the plaintiff’s business premises.
    The Court of First Instance and the Court of Appeal rejected the claim.

    The fact that the agreement had been reached by fax gave rise to differing interpretations in terms of where the defendant had formally agreed to the contract. There was room for different assessments, though these should be made with the law’s overriding purpose in mind: to guarantee that the contractual party normally in a weaker position is able to exercise his free will. Under circumstances where the consumer’s ability to exercise his free will would not ordinarily be jeopardised, the right of withdrawal under § 3 KSchG is subject to restrictions.
    In a situation where the consumer has accepted in writing a written offer sent to him without any further contact in the meantime, he is not entitled to any special protection. This is because such a situation offers the best conditions for the person accepting the contract to make a decision that is both considered and free of outside influence. Thus, he is not entitled to a right of withdrawal under § 3 para 1 KSchG, which applies in situations where there is typically an imbalance of power, hence in doorstep selling. If a consumer puts his agreement to a contract in writing himself and sends this document (either by post or by fax) to the supplier, then this is to be regarded as tantamount to his having agreed the contract on the supplier’s business premises. Thus, the defendant was not entitled to a right of withdrawal as per § 3 para 1 KSchG.
    As an obiter dictum, the OGH also confirmed that it is immaterial to whom the statement of acceptance was sent. Hence, when Austrian legislators were compiling a register of situations in which the consumer’s ability to exercise his free will is compromised, they did not consider that a property transaction might be concluded in a manner akin to a doorstep selling context. Therefore, with regard to property transactions, § 3 para 1 clause 1 KSchG should be applied in the same way to all locations that are equivalent to the supplier’s business premises in terms of agreeing a contract on movable objects because this is quite clearly the legislators’ intention. Thus, interpreting § 3 para 1 KSchG on the basis of the law’s purpose, it makes no difference whether the defendant sent the fax with her formal acceptance to the plaintiff, the estate agent or to both.
