    The Corte Costituzionale held that, under the article 1469-bis of the Italian Civil Code, a consumer is only is any natural person who, in contracts covered by this provisions, is acting for purposes which are outside his trade, business or profession.
    This interpretation of the article 1469-bis of the Italian Civil Code is in compliance with the articles 3, 25, and 41 of the Italian Constitution.
  • Fatti
    The Giudice di pace di Sanremo has submitted the case to the Corte Costituzionale asking the Court to decide whether the article 1469-bis of the Italian Civil Code is in compliance with the principles of the articles 3, 25 and 41 of the Italian Constitution.
    This because the current interpretation of that article excludes the legal persons, such as the companies and the professionals, by discriminating these subjects from the natural persons.
    As to the Giudice di pace di Sanremo the ratio of the discipline concerning the protection of the consumers’ interests should be interpreted as aiming to protect the weak party of the contract, without any other discrimination.

    The Corte Costituzionale has confirmed the prevalent interpretation of the jurisprudence about the article 1469-bis of the Italian Civil Code.
    The judges started by underlying that the Italian Law on the unfair terms in the consumers’ contracts is based on the Council Directive 93/13/EEC of 5 April 1993.
    The directive has been implemented in Italy by the Law no. 52 of 6 February 1996 “Disposizioni per l'adempimento di obblighi derivanti dall'appartenenza dell'Italia alle Comunità europee” (Legge Comunitaria 1994). And such Law has introduced the articles from 1469-bis to 1469-sexies in the Italian Civil Code.
    Upon the interpretation of the Corte Costituzionale, “consumer” is only the natural person who, in contracts covered by this provisions, is acting for purposes which are outside his/her trade, business or profession.
    As to the judges, this interpretation in accordance with the ratio of the Directive 93/13/CEE that expressly applies only to the persons acting for purposes which are outside trade, business or profession.
