    1. The discipline on the unfair terms in consumer contracts applies to the contracts agreed after its enforcement.
    Thus, the article 1469-bis and followings of the Italian Civil Code do not apply to an insurance contract, covering the professional risks of a nurse that has been stipulated before the adoption of such discipline in the Italian legal system.
  • Fatti
    The plaintiff is a nurse who, after having got a disease at work, has sued Assitalia S.p.a., asking the judge to oblige the insurance company to fulfil the obligations arising from an insurance contract for professional risks.
    The company rejected the demand by saying that the time limit to ask the payment for the risk has expired.
    The Tribunale and the Corte di Appello di Roma agreed with the company’s argument and the nurse brought the case before the Corte di cassazione.

    In the decision, the Corte di cassazione confirmed the previous jurisprudence upon which the articles 1469-bis and followings of the Italian Civil Code do not apply to the consumers’ contracts entered into force before their adoption.
    The Italian legislation on unfair terms in consumer contracts is based on the Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts.
    The discipline concerning unfair terms in consumer contracts has been implemented in Italy by the Law no. 52 of 6 February 1996 “Disposizioni per l'adempimento di obblighi derivanti dall'appartenenza dell'Italia alle Comunità europee” (Legge Comunitaria 1994). The Law no. 52/1996 has introduced the articles from 1469-bis to 1469-sexies in the Italian Civil Code.
