    To fix a period for performance according to article 281 paragraph 1 of the German Civil Code it is sufficient, if the creditor through his demand for immediate performance or without delay or promptly or a comparable formulation, indicates clearly that the debtor only has a limited (determinable) period for performance. It is not necessary to fix a specific time period or a particular due date.
  • Facts
    In December 2005 the buyer acquired from the defendant a used Mercedes SL 230 Pagode built in 1966 for a purchase price of 34,900 EUR. In the spring of 2006 he indicated a number of defects in the engine of the car. He demanded that the defendant remedy the defects promptly, or else he would entrust a different garage with the repairs and bill the defendant for the work. In response, an employee of the defendant declared that he would take care of the matter and would report it immediately. After the defendant had not contacted the buyer in the following period, and he had attempted in vain to reach the defendant by telephone, he charged a different garage with the elimination of the alleged defects on 7 April 2006. After the repairs had been completed he paid the amount due of 2,194.09 EUR and demanded the reimbursement of that sum from the defendant, in vain. The claimant, to whom the buyer has ceded his right to damages, claims these now. His claim failed in the lower courts.
  • Legal issue
    On appeal from the claimant, the Federal Court of Justice referred the case back to the court of appeal. Under article 281 paragraph 1 sentence 1 of the German Civil Code the buyer may only claim damages in lieu of performance for a repairable defect if he has previously fixed the seller a period for performance or supplementary performance. For the required fixing of a period for performance it suffices if the buyer demands that the seller eliminate the defects promptly. The indication of a particular due date or time period is not necessary for the determination of an appropriate period for performance. A period for performance is a determined or determinable period of time. With the demand for prompt supplementary performance, a time limit is set that is determinable according to the circumstances of the individual case. The purpose of the fixing of a period for performance, to indicate to the debtor that he may not perform at a time of his choosing, but that there are time limits, is fulfilled by this. Since the alleged defects had not been determined sufficiently, the case was referred back to the court of appeal.
