    By applying article 4 para. (1), (2) and (3) of the Law no. 193/2000 on abusive clauses in the contracts concluded between traders and consumers (which transposes art. 3 para 1, art. 2 lit. a, art. 3 para 2, 1st sentence of the Unfair Terms Directive 93/13) the Constanta Appeal Court held that the clause contested by the claimant is abusive. The contract which contains the abusive clause was a preformed standard contract and it was unilaterally established by the respondent. In contracts between consumers and merchants, non negotiated clauses that cause clear disadvantages to consumers are void and punished by the law.
