    The plaintiff is the minister for consumer protection. The defendant conducts an online dating agency and applies terms and conditions in contracts with its clients. In the plain-tiff’s view the terms and conditions contain several unfair clauses and therefore infringe the Loi modifiée du 25 août 1983 relative à la protection juridique du consommateur. Furthermore, the plaintiff applies for the publication of the court’s decision according to Art. 5 of the Loi modifiée du 25 août 1983 relative à la protection juridique du consom-mateur.

    The action has become unfounded because the defendant changed its terms and condi-tions in compliance with the provisions of the Loi modifiée du 25 août 1983 relative à la protection juridique du consommateur prior to the judgement.     Art. 5 of the Loi modifiée du 25 août 1983 relative à la protection juridique du consom-mateur is the transposition of Art. 7 of the Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts stating that the Member States shall ensure that adequate and effective means exist to prevent the continued use of unfair terms.
