  • Fakti
    The defendant traded goods (mainly electronic devices) on its website. On the website the defendant had provided that the descriptions of the goods were for information purposes only, and if the information was wrong due to human or technical error, the defendant would not bear any liability. The court ordered the defendant to remove such a disclaimer from its website. Therefore, the defendant changed the disclaimer to one, which provided that the consumers prior to purchasing the goods shall consult the defendant via phone to make sure that the information on the goods in the description is correct. According to the defendant, this did not prejudice the consumers’ rights as the disclaimer had no legal implications. Still, the section on the website dealing with the guarantees of goods provided a disclaimer similar to the first one – that the incorrect description of goods imposes no liability upon the defendant.

  • Lēmums

    (1) First, the court stated that the disclaimers on the defendant’s website, which provided that the defendant bears no liability for incorrect description of the goods, are invalid conditions of distance contracts, as the main characteristics included in the description, being the only source of information on goods sold online, constitute integral part of a distance contract.
    (2) Second, the court found that that the defendant was liable if the information on the goods were incorrect, because in the case of distance contracts the description is the only basis for deciding whether to purchase goods or not, thus, this basis must be accurate. The defendant cannot relieve itself from this liability via disclaimer.
