  • Leitsatz
    All price components regarding a package holiday have to be included in the total price. However, advertisements "starting at a price of …" and separately displaying surcharges for varying alternatives are not illegal, even if the total price for each variant is not indicated.
  • Sachverhalt
    The defendant, a German tour operator, advertises package holidays in various Austrian media.
    The cheapest variant of each package was highlighted with "starting at a price of …" whereas these cheap variants were only available at determined booking dates. Surcharges for other booking periods were shown distinctively in a separate schedule, however without displaying a total price for each variant. Customers could easily calculate the respective total price.
    The plaintiff asked the court whether the defendant violated price labelling provisions by indicating prices in advertisements by mentioning prices "starting at a price of …" and displaying different surcharges for differing variants separately, but without indicating a total price.

  • Entscheidung

    The Court highlighted the purpose of the Price Labelling Act is to ensure clear and comprehensible prices and emphasized that infringements of the Price Labelling Act are considered misleading practices under the Unfair Competition Act.
    Although the defendant advertised in an eye-catching manner the package holiday with "starting at a price of …", he also disclosed all components from which the final total price for all variants of the package holiday available to the consumer can be calculated. Thus, the defendant disclosed all additional costs sufficiently and comprehensibly. Therefore, the defendant did not show the price in a misleading manner nor in contradiction to the requirement of § 9 Sec 1 of the Price Labelling Act to include the VAT plus all further duties and surcharges of the price.
