  • Facts
The plaintiff (debtor) has executed various loan agreements in order to acquire buildings for rental purposes. The plaintiff sued the defendant, requesting the court to consider certain clauses providing the payment obligation of a risk charge in favour of the defendant as being unfair and, therefore, excluded from the loan agreements.
  • Legal issue
The court found that the individual who has concluded several credit facilities in order to refinance other loans and to acquire real estate buildings for rental purposes is not included in the consumer's category who benefit from protection under Directive 93/13/EEC. Although the individual may be qualified as a consumer, Law no. 193/2000 on unfair terms in consumer contracts describes the consumer as any individual or group of individuals forming association acting for purposes outside their professional activity.
