    (1) When assessing whether a contractual term is unfair, the court must examine whether the use of such term results in an unfavourable status for the consumer as compared to the status in which the consumer would be pursuant to applicable laws.

    (2) When assessing whether the imbalance in the parties’ rights and obligations was caused contrary to the requirement of good faith, the court must examine whether the trader - if acting in good faith - may have reasonably expected the consumer to accept such term during an individual negotiation.
  • Tények
    The plaintiff concluded a consumer credit agreement in foreign currency with the defendants for the purpose of real estate construction. The plaintiff later contested several provisions of the contract, claiming that such provisions are considered unfair.

    The first instance court mainly rejected the plaintiff's claims, except with respect to the contractual term enabling the defendants to apply different exchange rates to the advance of the loan and to its repayment. The first instance court held that such term is considered unlawful, because no actual exchange of currency occurs between the parties, thus using different exchange rates creates an unfair imbalance in the parties' rights and obligations arising out of the contract.

    One of the defendants appealed the first instance judgement, but the second instance court upheld it with the same reasoning.
