(1) Consumer associations are entitled to file actions on behalf of their members.

(2) A round up provision, even though it is an essential condition of the contract, must be considered an adherence provision.
The plaintiff included in its mortgage loan contracts a "round up" provision, allowing to round the interest rate applicable to the mortgage loan. The first instance decision ruled that this was an adherence condition and that it was abusive and ordered the plaintiff to cease including the same in its contracts with consumers.
(1) Are consumer associations entitled to file a claim on behalf of their members?

(2) Can the "round up" provision be considered and adherence provision?
The Court decided to endorse the title of the plaintiff to act in court on behalf of its members and confirm the first instance decision.
