  • Hechos
    The plaintiff contracted a tourist package for travelling to the Dominican Republic. The package was booked for execution in September. A hurricane spoiled the trip and prevent the plaintiff from enjoying her honeymoon. The plaintiff filed a claim asking for compensation grounded on the negligence of the defendant, who failed to inform in advance that September is a month where hurricane s are frequent in the Dominican Republic. The claim was dismissed in first instance as the hurricane was considered to be a force majeure event.

  • Decisión

    The defendant is a professional (travel agency) of the sector and was fully aware that hurricanes were frequent in September in the Dominican Republic. It should have informed the plaintiff on the potential damages for the trip and for the plaintiff's own safety if she decided to travel at that moment. A force majeure event is per se unpredictable and therefore only applicable to situations that could have not been anticipated by the defendant, which is not the case for the hurricane. The travellers being in their honeymoon, moral damages compensation must be awarded in addition to regular damages compensation.
