As customers, each of the plaintiffs entered into a travel contract with the travel agent, in which the travel agency was to provide them with a trip to Turkey on the specified date. The plaintiffs paid a deposit of 50% of the total price of a tour, which did not take place due to the bankruptcy of the travel agency. From the insolvency insurance of the travel agency, the defendant provided each of the plaintiffs indemnification of up to 5.4% of the advance payment (deposit), claiming that they could not cover the damages of the travel agency's clients above the limit of the insurance limit agreed in the insurance contract.
