How and where to pay the court fees?#05
Court fees are governed by Act No 549/1991 on court fees. The Schedule of Fees is annexed to the Act. The fees shall be allocated to the national budget.
The fees are paid by bank transfer to the account of the competent court. Fees not exceeding CZK 5 000 may also be paid by tax stamps.
For the small claims procedure, court fees must be paid in accordance with the general rules. The same rules apply as for other civil proceedings.
The rates of fees for proceedings are laid down as a fixed sum or as a percentage of the base of the fee. A percentage fee is calculated by multiplying the base of the fee by the rate of the fee. The individual rates are set out in the Schedule annexed to Act No 549/1991 on court fees.
From the point of view of the European Small Claims Procedure, a basic rule is based on a monetary criterion. A fixed sum of CZK 1000 is payable for an application for civil proceedings concerning the payment of a sum of CZK 20 000 in cash.
Where the fee payable in respect of the bringing of proceedings, appeals, appeals or appeals has not been paid, the court shall invite the taxpayer to pay it within a period of at least 15 days. By way of exception, the court may specify a shorter period. Following the expiry of that period, the court shall cease the proceedings. The payment of the fee after the expiry of the period shall be disregarded.
If, after the case has been brought before it for a decision to appeal, the appeal court finds that the fee due has not been paid due, the appeal court shall invite the taxpayer to pay within a period which shall be at least 15 days. By way of exception, the court of appeal may specify a shorter period. Following the expiry of that period, the appeal court shall cease the proceedings. The payment of the fee after the expiry of the period shall be disregarded. The procedure before the court of leave shall apply mutatis mutandis.
If the order suspending the proceedings for the failure to pay the tax is terminated, it shall cease to apply.
The fees are paid by bank transfer to the account of the competent court. The bank details can be found on the websites of the individual courts, which are available from the web portal https://www.justice.cz/. https://www.justice.cz/ Fees of up to CZK 5 000 may also be paid by tax stamps.
In matters relating to court fees, the court shall decide which court is competent to hear and determine the case at first instance.
By sending money to the competent court’s bank account or by making the stamps available to the competent court, the obligations of the taxpayer with regard to the payment of court fees are fulfilled. No other documents are required to be submitted to the court.
