Information on the application for an extract/copy of a criminal record

As of 01.11.2015, an extract and a copy of the criminal record may be lodged only at the Criminal Registry Office of the Slovak Republic — Kvetná 13, Bratislava. Applications will be dealt with under the ‘rush’ regime.

Extract from the Criminal Record

The extract from the criminal record shall indicate unregularised convictions by the court of the Slovak Republic, as well as by the court of another Member State of the European Union and by the court of another State whose decisions have been recognised by the court of the Slovak Republic, including information on the conduct of the penalties imposed, the protective measures and the appropriate restrictions or obligations if the court or the law does not judge the offender, as if he had not been convicted.

Depreciation of the criminal record

A copy of the criminal record is an authentic instrument which provides details of

  • any definitive conviction, including a court of another Member State of the European Union or a court of another State whose decision has been recognised by the court of the Slovak Republic;
  • the conduct of the sentence and the course of the execution of the protection measure,
  • convictions, although they have been dealt with by court decision or by law.

A write down of a criminal record includes data on the

  • a final court decision or a final decision of a prosecutor to suspend the prosecution;
  • a final decision of the court or of a legal decision of the public prosecutor approving an amicable settlement and cessation of criminal proceedings;
  • a final conviction of a citizen of the Slovak Republic, or of a final conviction of a person permanently resident in the territory of the Slovak Republic, by a court of a State other than a Member State of the European Union which has not been recognised by the court of the Slovak Republic, stating that that decision has no legal effect in the territory of the Slovak Republic and is for information only.

A write down of criminal records issued for the purposes of Section 14 (2) and (3) of the Criminal Records Act and amending certain acts, in relation to a pending conviction by a court of another Member State of the European Union and a court of another State which has not been recognised by the court of the Slovak Republic, shall indicate that these decisions do not have legal effects on the territory of the Slovak Republic and are for information only.

Reply to request for criminal record information

If the central authority of another Member State of the European Union requests the Public Prosecutor’s Office for criminal record information concerning a public Slovak citizen, the General Prosecutor’s Office shall provide it within ten working days with information on the

  • a final unexpunged conviction by a court in the Slovak Republic which is registered in the criminal record;
  • a final unregularised conviction by a court of another Member State of the European Union, which has been updated pursuant to Article 17 (4) of the Criminal Records Act and amending certain acts;
  • a final unexpunged conviction by a court in other States which has been provided and is registered in the criminal record.
