Unfair Contract Terms Directive, Article 5

The article is about the requirement of transparency pursuant to Article 5 Directive 93/13/EC which requires all consumer contracts to be in writing and to be clear and comprehensible. This Article was implemented into national law by § 6 Sec 3 Consumer Protection Act but in Austria, the requirement of transparency is only applicable for general terms and conditions and contract forms. The author analyses which problems this difference may cause.
