The article analyses the distinction between the tour organizer and the tour agent, and compares regulation of this matter before and after the implementation of the Directive 90/314/EEC in Croatian law. Attention is drawn to the problems of distinction between the tour organizer and the tour agent that were identified in the implementation and application of the Directive in other countries, and the problems of distinction in Croatia before and after its implementation in the Civil Obligations Act.
