The self-regulation boom has acquired a greater presence in the mercantile traffic, together with its public promotion from the public authorities, which has led to the proliferation of codes of conduct. Operators from different sectors have agreed to those codes, which implies that new assumptions must be studied from a legal scope against unfair competition. In this document, we analyze the effectiveness of legal current expectations and we suggest a new interpretation of applicable law, based on the distinguishing function of the self-regulation systems, as distinctive features, so that both the misuse and the breach could be framed as acts of outside reputation exploitation.
