    Schönheitsreparatur-AGB vor ihrem Unionsrichter: Die Klauselrichtlinie als Stolperstein für das „Kompensationsmodell“ des BGH. Überlegungen zur notwendigen Abschreckungswirkung von Art. 6 I Richtlinie 93/13/EWG.


    The author discusses the case law of the German BGH (Federal Court of Justice) on cosmetic repair clauses in tenancy agreements, focusing in particular on whether the obligatory deterrence effect of article 6 paragraph 1 Directive 93/13/EEC and the preventive effect of article 7 paragraph 1 Directive 93/13/EEC are sufficiently taken into account by the BGH. The author concludes that, in particular, the possibility to transfer the obligation for cosmetic repairs to the tenant in the case of not renovated rooms and rooms in need of renovation, accepted in BGH decision of 18.03.2015 (VIII ZR 185/14, NJW 2015, 1594), infringes article 3 paragraph 1 Directive 93/13/EEC, as such clauses are irreconcilable with the deterring effect according to article 6 paragraph 1 Directive 93/13/EEC and the preventive effect according to article 7 paragraph 1 Directive 93/13/EEC.
