    Musterfeststellungsklage: Eine erste Bewertung.


    The author analyses the legal protection of collective consumer interests in Germany. He compares the new “Musterfeststellungsklage” with the Europe-wide initiative of a New Deal for Consumers. First, he examines the current possibilities of collective law enforcement in Germany, focusing on the class action according to UWG and UKlaG. The author analyses the necessity, suitability and the scope of application of the “Musterfeststellungsklage”. The author furthermore raises some unanswered questions with regard to the “Musterfeststellungsklage”. Is there a lack of attractiveness for qualified entities? Will proceedings take too long? Are the courts well-equipped enough? The author points out another problem, namely that the “Musterfeststellungsklage” has only a declaratory effect. Then he outlines the importance of settlements for collective actions. Moreover, he takes on the issue of claims of the applicants against the qualified entities (recourse claims). He raises the question of the relationship between the “Musterfeststellungsklage” and the proceedings under the “KapMuG”, which is a similar model procedure for investors in capital market law disputes. Finally, he points out the conflict in German law between individual justice and effective collective enforcement.
