    In this paper, Faraj and Tigelaar look into the question of how the action of a competitor against unfair commercial practices in the light of the Tort Law is practical. On the basis of case-law analysis, they come to the conclusion that courts spend less time considering the requirements of accountability, damage, and causality. Instead, courts’ legal reasoning largely pertains to the qualification of the use of an unfair commercial practice as ‘violation of the law’ or (in particular in appeal cases) ‘breach of the duty of care’. According to the authors, the matter of qualification should not be emphasised to such extent as is currently the case. Instead, they argue, courts should focus more attention on matters of damage and causality.
