Nationales Verbot von Verlustverkäufen im B2B-Sektor und die UGP-RL. Anmerkung zum Urteil des EuGH vom 19. 10. 2017 (C-295/16 - Europamur).

In its decision C-295/16, Europarmur, the ECJ dealt with the compatibility of Directive 2005/29/EC on unfair commercial practices and the Spanish prohibition on loss sales by wholesalers. In its decision, the ECJ referred to the necessity of a case-by-case assessment and thus recognised a contradiction of the Directive with national law.
