In this article, the authors compare Consumer Protection Law with Constitutional Law. The article underlines the importance of European law, which shapes the content of many consumer rules and thus largely supersedes Constitutional Law as a standard of review. National Constitutional Law represents an "intermediate layer" which can only serve as a yardstick to the extent that it has left room for manoeuvre by European Union law. The constitutionally secured right to freedom of employment, the guarantee of ownership and the principle of equality are linked to the consumer protection provisions, whereby reference is repeatedly made to decisions of the Constitutional Court.
