This paper deals with the question of when dual-use contracts, which were concluded partly for professional and partly for private purposes, are to be assessed as consumer contracts. The prerequisites are discussed on the basis of a consumer contract of sale, whereby Directives 1999/44/EC and 2011/83/EC are also used for interpretation.
