De buitengerechtelijke ontbinding eindelijk erkend: van het ontbonden beschouwen naar de ontbinding op kennisgeving.

The authors carefully sketch the evolution in case law and critically assess the Court of Cassation’s judgement of 23 May 2019 allowing for extrajudicial termination of contracts. They submit that this judgement will certainly have a considerable impact on consumer (sales) contracts. In doing so, the Belgian Court of Cassation anticipated the new provisions of the Directives relating to consumer goods and digital content wherein out of court termination by notification of the consumer is introduced.
