    European consumer law prescribes many information duties for traders concluding contracts with consumers as regards the object of a contract, its specific conditions, as well as consequences of its conclusion. In order for information duties to fulfil their purpose, that is to allow consumers to make an informed and rational decision to conclude a contract, information needs to be provided transparently. The article illustrates the problem of the lack of transparency in the current regulation, application and interpretation of the principle of transparency in Polish consumer law. Specifically, the analysis pertains to the notion of transparency as used in the Polish Civil Code, when addressing transparency of standard terms and conditions in consumer contracts, as well as in the recent implementation of the European information obligations for traders to Polish law, that is the Consumer Rights Act of 30 May 2014 and the Consumer Credit Act of 12 May 2011. Suggestions are made on how to further specify the notions and requirements of the principle of transparency to increase legal certainty, as well as ensure conformity of Polish law with European consumer law.
