Through analysis and comparison of the Supreme Court’s judgement in relation to the validity of credit agreements in Swiss francs, the authors show that the Supreme Court’s case law is in fact uniform/harmonised despite occasional but unfounded doubts. The authors also discuss the view of the Slovenian Supreme Court regarding legislation of credit agreements in Swiss francs, content and scope of the obligation to inform of banks and sanctions regarding unfair contractual provisions. Furthermore, the authors compare different states in the cases of the Supreme Court and even examine the decisions of the lower courts.
