    This article deals with the decision of the ECJ 18. 11. 2020, C-519/19, Ryanair/DelayFix. The author agrees with the ECJ that jurisdiction clauses that are disadvantageous for the consumer and not negotiated in detail may be unfair within the meaning of Art 3 (1) iV, Annex 1 no. 1 lit q of D. 93/13/ECC, as the national implementations of D. 93/13/ECC concern the substantive validity according to Art 25 (i) Regulation (EU) No 1215/2012. Regarding the personal scope of jurisdiction clauses and the applicability of D. 93/13/EEC, the author argues that when a consumer assigns claims to an entrepreneur, the latter is bound by the jurisdiction clause if he/she enters into all rights and obligations associated with the right to claim.
