  • Headnote

    The article provides an overview on the concept of “consumer” under the energy law premise, as opposed to the general consumer law in EU. It stresses that the pivotal concept for the energy law is that of “customer”, which is defined by the secondary Union law in a uniform way. It clarifies the distinction between household and non-household customers, applied especially to electricity supply, and it follows the formation of the “final energy consumer” notion in the course of time. The author also emphasises that, except for the specialised legislation, the general consumer protection texts apply, invoking the protective power of D. 2005/29 and 2011/83. He also elaborates on the normative power of D. 93/13 which allows for Member States to take stricter measures for controlling any unfair practices in the field or the price/cost sufficiency or for drafting catalogues of contractual terms which shall be considered illegitimate.
