This article provides a general discussion on the implementation and enforcement of the UCP Directive in Dutch law. As to civil enforcement, the author discusses unfair commercial practices (1) as an unlawful act, and (2) as a breach of contract. The enforcement by supervisory bodies, the position of competitors and the enforcement of codes of conduct by civil law are also discussed.
