This book includes an interpretation of the law 2251/1994 (protection of the consumers) per article. Article 5 of the aforementioned law includes the obligation of the seller to provide information regarding the instructions for the product’s safe use as well as the product’s life span. In addition it sets the obligation for granting a guarantee and of ensuring the after-sales service. The author refers to the relationship between the provisions provided by law 2252/1994 and by Civil code, with respect to the seller’s liability.

 

Among all other articles, it incorporates a specific chapter regarding the articles of that law (articles 9a – 9 i) that have incorporated the Unfair Commercial Practices Directive in the greek law. In specific it includes an analysis of the unfair commercial practices either as misleading or as aggressive ones and it contains an indicative list and examples of diverse cases of unfair practices while at the same time the author describes the penalties set by the courts while enforcing the law.

 

It contains a chapter that refers to the lawfulness of the General Terms of Transactions (pre-defined standard contractual clauses for future contracts). It first examines those clauses in light of the freedom of contracts principle and analyses also their meaning and their scope in the transactions in general. In addition, the lawfulness of those terms is assessed in view of how they are implemented in a contract (knowledge of their content from the consumer – clear and written form, use of the right language, receipt of the consumer’s consent). Further, the author elaborates on how they should be interpreted and on how the abusiveness principle is examined. Lastly, the author points out specific examples of the use of such terms in the banking transactions.
