The article examines the effect of a decision of the Court of Justice of the European Union (C-65/09 and C-87/09, Weber and Putz) on the Dutch and German legal orders. The decision was fervently criticised at the time by various commentators but the effects for consumers have so far been limited, as courts have invoked national consumer protection law to deal with the problems.
