  • Headnote
The article provides a comprehensive analysis of EU law regulating timesharing and its impact on Polish law.

At the beginning, the authors explain the definition, role and function of timeshare and the development of this legal institution. It is emphasized that the regulation of timeshare at the EU level results from its increasing development in the Community. In Poland this institution was introduced in the 1990s.

The author discusses the characteristics of Directive 94/47/EC - the predecessor of the current Directive 2008/122/EC - and describes the instruments of consumer protection included in its provisions.

The reason for reforming the existing legislation and adopting the new Directive 2008/122/EC was the need to ensure proper protection to consumers purchasing products similar to timeshare and concluding related contracts.

The author explains and assesses the changes introduced by Directive 2008/112/EC and describes the instruments of consumer protection contained in this act. The article also discusses the impact of the new EU legislation on Polish law.
