This article explores the Tourism Code, Legislative Decree n.79/2011, Annex A which transposes Directive 90/314. In particular, the main focus is on the breach of contract, (the failure to perform or improper performance of the contract) and explains in a clear and detailed way the new "ruined holiday damage" as shaped by art. 47 of the Legislative Decree No. 79/2011.
