    This book analyses the relationship between private autonomy and consumer protection through a more modern point of view, based on a combination of law, finance and psychology principles. More specifically, chapter three, refers to the legal paternalism deriving from the Directive 2011/83 and especially in relation to the right of withdrawal in the distance and off the premises contracts as well as to the alternative model of mandatory choice. In this specific matter, the author focuses on the one hand on a general presentation of the content of the Directive 2011/83 (scope, level of targeted harmonization, pre-contractual information requirements, right of withdrawal, other consumer’s rights, the passing of risk for loss or damage of goods to the consumer and other consumer protection provisions) and on the other hand on a detailed legal and political examination of the right of withdrawal and the model of obligatory choice.
