Regeringens proposition 2019/20:63,tydligare regler vid konsumentavtal

    Regeringen

This proposal includes changes related to consumer contracts in general, and more specifically, to information that must be provided by a trader before the conclusion of a contract. The changes are expected to provide a better implementation of the Consumer Rights Directive (2011/83/EU) since the Swedish implementation had received some critique by the Commission. The reason was that some provisions of the Directive were only referred to in the preparatory works of the national legislation and not the body of the different laws. It changes 4 national laws: Consumer Sales Act, (1990:932), Law (1994:1512) on contractual terms in consumer relationships, the Distance and Off-Premises Contracts Act (2005:59), and the Marketing Act (2008:486). The most important changes are, for example, the provision of a form by the trader for the exercise of the right of withdrawal, information to be provided with regards to digital content, and the definition of the term “guarantee”.
