At the basis of the unfairness of the analysed clause, is the imposition on the consumer of a narrative contract template (in the form of personal statements), which may lead to determining in writing the circumstances of the contract in a manner inconsistent with their actual course, which in turn may hinder the consumer's ability to pursue claims related to the concluded contract, and will allow  the company or a third party cooperating with it to be exempt from the liability  for dishonest acts or omissions at the pre-contractual stage.
