This guidance document from the Economic Inspection helps businesses to avoid unrealistic representations when using graphic images and statements on the packaging of foodstuffs that may mislead the consumer as to the nature or main characteristics of the product (see Article 6(a)(b) UCPD). The guidance builds on a combined application of the relevant EU legislation: Regulation No 1169/2011 on the provision of food information to consumers, Regulation No 1134/2008 on flavourings and certain food ingredients, the Unfair Commercial Practices Directive and more particularly the Teekanne judgement of the CJEU. The Economic Inspection advises that graphic images or statements should not be used at the expense of the content or clarity of mandatory information obligations on the labelling, nor mislead the consumer about the flavour of the foodstuff. In the event of graphic images or statements that may mislead the consumer, the Economic Inspection requires the food retailing business to provide additional information specified in accordance with the Economic Inspection to avoid an infringement of the Code of Economic Law and corresponding national sanctions.
